Personal data that we process


Brainial processes your personal data because you use our website, services and/or because you supply them to us yourself.

Below you will find an overview of the personal data we process:

- First and last name;
- Telephone number;
- E-mail address;
- IP address;
- A profile picture that may be clearly identifiable;
- Data about your activities on our website;
- Internet browser, device type and operating system;

Special and/or sensitive personal data that we process


Our website and/or service does not intend to collect data on website visitors who are younger than 16 years old. Unless they have permission from their parents or guardian. However, we cannot verify whether a visitor is over 16. We therefore recommend that parents be involved in the online activities of their children, in order to prevent data being collected on children without parental permission. If you are convinced that we have collected personal data on a minor without such consent, please contact us at privacy@brainial.com and we will delete this information.

For what purpose and on what basis do we process personal data?


Brainial processes your personal data on the basis of consent, performance of an agreement, legal obligation and legitimate interest. The processing of this data serves the following purposes:

- Sending our newsletter;
- To be able to call you or send you an e-mail if this is necessary to perform our services;
- To inform you about changes to our services and products;
- To offer you the possibility to create an account and to login to our services;
- To deliver goods and services to you;
- To improve the website and to tailor the range of products and services to your preferences;
- For recruiting new employees;
- Brainial also processes personal data if we are legally obliged to do so;

Automated decision making


Brainial does not make decisions about matters that can (significantly) affect people, based on automated processing. These are decisions made by computer programs or systems, without a human being (for example an employee of Brainial) being involved.

Sharing personal details with third parties


On the Brainial website you will find a number of hyperlinks to other websites. Brainial can not be held responsible for the handling of your data by those parties. Please read the privacy statement, if any, of the site you visit.

Brainial will not sell your information to third parties and will only provide it if necessary for the execution of our agreement with you or to meet a legal obligation. We have a processor's agreement with companies that process your data on our behalf, to ensure the same level of security and confidentiality of your data. Brainial remains responsible for this processing.

Cookies, or comparable techniques, that we use


Brainial uses cookies to optimise the functionality of certain pages of the website. Cookies are small text files that are placed on the visitor's computer by a page of the website. In such a cookie information is stored such as certain preferences of the visitor. This enables Brainial to serve the visitor even better on his next visit. The visitor can decide for himself how to deal with cookies. He can set his browser in such a way that it allows the use of cookies, does not allow them or allows them partially. In the latter case, he can set which websites are allowed to place cookies. All other websites will then be prohibited.

Brainial also uses Google Analytics and Hubspot to analyse how users use our public website. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google and Hubspot on servers in the United States. Google and Hubspot will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.

Viewing, amending or deleting data


You have the right to inspect, correct or remove your personal data. You also have the right to withdraw your permission for the processing of your personal data or to object to the processing of your personal data by Brainial and you have the right to data portability. This means that you can request us to send the personal data we have on you in a computer file to you or another organisation named by you.

You can send a request for inspection, correction, deletion, data modification or request to withdraw your permission or objection to the processing of your personal data to privacy@brainial.com.

To make sure that the request for inspection is made by you, we ask you to send a copy of your identity document with the request. Please make sure that your passport photo, MRZ (machine readable zone), passport number and Citizen Service Number (BSN) are blackened in this copy. This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.

How we store and protect personal data


We will not keep your data longer than necessary. Brainial takes the protection of your data seriously and takes appropriate measures to prevent abuse, loss, unauthorised access, unwanted disclosure and unauthorised changes. If you have the impression that your data is not properly secured or there are indications of misuse, please contact us via privacy@brainial.com.

Job applications


Your application provides us with your personal details like name, address, date of birth and telephone number, CV and cover letter. By sending in your application you also give us permission to carry out an online screening as part of the application procedure (e.g. LinkedIn etc.).

Brainial will store your personal data in a secure database for a period of 4 weeks, with permission for 12 months. We will not pass on your information to third parties for commercial purposes. Only third parties that help us find new colleagues sometimes need access to (parts of) your data. We make sure that these third parties handle your information with care and adhere to all rules.


Changes to this statement

Technological developments, legislation or modified business processes necessitate that Brainial amend this Privacy Statement from time to time. You can see the date at the bottom of this Privacy Statement when it was last amended. Brainial may unilaterally amend this privacy statement. We therefore advise you to check this Privacy Statement regularly for changes.
